Enabledoc Terms of Service

Effective Date: January 1, 2025

1. Services Overview

Enabledoc offers healthcare-related software applications designed for healthcare providers (Enablemypractice) and patients (Enablemyhealth). These applications allow for practice management, patient communication, scheduling, medical records, and more. Integration with third-party services such as Google Calendar and Gmail via OAuth enables synchronization of appointments and secure email communications.

2. Eligibility and Account Registration

To use the Services, you must:
– Be at least 18 years old.
– Register for an account and provide accurate, current, and complete information.
– Maintain the confidentiality of your account credentials.
– Be a licensed medical provider, employee of a provider, or a registered patient with an authorized provider.

3. HIPAA Compliance and Protected Health Information (PHI)

Enabledoc complies with the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and protects the confidentiality, integrity, and security of PHI stored or transmitted through our Services.

Your Responsibilities:
– Do not upload or transmit PHI unless you are authorized to do so.
– Use secure access and approved workflows to manage PHI.
– Inform Enabledoc immediately if you suspect a data breach or unauthorized access.

4. Google OAuth Integration

Our Services may allow you to link your Google account to sync:
– Calendar events (e.g., patient appointments).
– Gmail communications (e.g., appointment reminders or secure messaging).

By enabling OAuth integration, you agree to:
– Grant Enabledoc access to your Google account information as permitted by your settings.
– Allow calendar read/write access for scheduling.
– Allow email access for sending or retrieving healthcare-related messages.

Enabledoc does not store your Google credentials and uses access tokens securely as per OAuth 2.0 standards. You may revoke access at any time via your Google account settings.

5. Permitted Use

You may use the Services solely for lawful and authorized healthcare purposes. You agree not to:
– Reverse-engineer, disassemble, or attempt to derive source code.
– Use the Services to send spam or unauthorized messages.
– Introduce malware, viruses, or other harmful content.
– Share or misuse patient data without proper authorization.

6. Third-Party Services and Content

Some features may rely on third-party services (e.g., Google, labs, e-prescribing platforms). Enabledoc is not responsible for the reliability or data practices of third-party providers. Use of these integrations is at your discretion and governed by their respective terms and privacy policies.

7. Data Ownership and Privacy

– All data you input or generate (including PHI) remains your property or the property of your organization.
– Enabledoc acts as a Business Associate under HIPAA and only uses data as necessary to provide services and support.

8. Service Availability and Support

We strive to maintain high availability but do not guarantee uninterrupted service. Scheduled maintenance and unexpected outages may occur. Support is available through our helpdesk and service-level commitments defined in customer agreements.

9. Fees and Billing

Use of the Services may be subject to fees under a separate service agreement. Failure to pay may result in service suspension or termination.

10. Termination

We may suspend or terminate your access if you:
– Violate these Terms.
– Fail to make payment.
– Misuse the Services or violate applicable laws.

You may terminate your account by contacting our support team. Upon termination, access to your data will cease except as required by law or under a signed data retention agreement.

11. Limitation of Liability

Enabledoc is not liable for:
– Indirect, incidental, or consequential damages.
– Loss of data due to misuse or unauthorized access.
– Actions of third-party services integrated with our platform.

Our total liability is limited to the amount paid by you to Enabledoc for the Services over the previous 12 months.

12. Modifications to Terms

We reserve the right to update these Terms. If we make material changes, we will notify users via email or in-app notification. Continued use of the Services after the changes become effective constitutes your agreement to the new Terms.

13. Governing Law

These Terms are governed by the laws of the State of [Insert State], without regard to its conflict of laws rules.
